Abstract
HAVAİ FİŞEK ÖZELİNDE PİROTEKNİK MALZEME MEVZUATININ MUKAYESELİ İNCELEMESİ VE BİR MODEL ÖNERİSİ Patlayıcı maddelerin yapılarında ve kullanım alanlarında, icat edilmelerinden günümüze kadar olan süreçte, teknolojide ve harp sanayisinde meydana gelen gelişmelere paralel olarak çok büyük mesafe kat edilmiş; yüksek teknoloji ve inovasyon uygulamaları sayesinde patlayıcı maddelerin sivil hayatta kullanımı askeri uygulamalarda kullanımından daha yaygın hale gelmiştir. Patlayıcı maddelerin yaygın olarak kullanılır hale gelmeleri; üretim, depolama, satış ve son kullanım süreçleri boyunca uyulması hayati öneme haiz yasal mevzuatın titizlikle hazırlanmasını elzem kılmıştır. Bu doğrultuda patlayıcı maddelere yönelik hazırlanan mevzuat sadece iç hukukta yer alan ihtiyaçlara göre değil uluslararası normları da esas alarak geliştirilmektedir. Bu durum patlayıcı maddelere yönelik mevzuatın teknolojik gelişmelerle birlikte uluslararası hukukta yer alan yeni düzenlemelere göre sürekli güncellenmesini zorunlu kılmaktadır. Bu tez kapsamında; ülkemizde çok geniş bir kullanım alanına sahip olan patlayıcı madde türlerinden, havai fişekler özelinde piroteknik malzemelere yönelik geniş bir literatür araştırması yapılmıştır. Müteakiben, Birleşik Krallık'ta ve Türkiye'de yürürlükte olan piroteknik malzemeler yasal mevzuatı kapsamlı olarak incelenmiştir. Son bölümde ise yasal mevzuatımızda yer alan eksiklikler gerekçeli olarak tespit edilerek bir model önerisi geliştirilmiştir. COMPARATIVE ANALYSIS OF PYROTECHNIC MATERIAL REGULATIONS ON FIREWORKS AND A MODEL PROPOSAL A great distance has been covered in the structures and areas of the use of explosives. However, in the process from their invention to the present, parallel to the developments in technology and the war industry, thanks to high technology and innovation applications, the use of explosives in civilian life has become more common than in military applications. Moreover, as stated above, the widespread use of explosives has made it essential to meticulously prepare legal regulations, which are vital to be followed during the production, storage, sales, and end-use processes. In this direction, the legislation drafted for explosives is developed not only according to domestic law needs but also based on International Norms. This situation makes it obligatory to constantly update the legislation on explosives according to the new regulations in International Law and technological developments. Within the scope of this thesis, extensive literature research has been conducted on pyrotechnic materials, especially fireworks, among the explosive materials that have a wide range of uses in our country. Subsequently, the legal regulations for pyrotechnic materials in use in the United Kingdom and Turkey were thoroughly examined.
