Abstract
Banka ve tüketici arasında imzalanan tüketici kredisi sözleşmelerinde, banka kredi alacağını tahsil edememe ihtimalini ortadan kaldırmak amacıyla tüketiciden teminat ister. Bu teminat ayni ya da şahsi olabilir. Ne var ki ayni teminatların masrafının yüksek olması nedeniyle bankalar daha ziyade şahsi teminatları tercih etmektedir. Şahsi teminat sözleşmelerinin bir türü olarak, konumuzu oluşturan kefalet sözleşmesi, Türk Borçlar Kanunu (TBK) m. 581'de şu şekilde tanımlanmaktadır:'Kefalet sözleşmesi, kefilin alacaklıya karşı, borçlunun borcunu ifa etmemesinin sonuçlarından kişisel olarak sorumlu olmayı üstlendiği sözleşmedir.' 6502 sayılı Tüketicinin Korunması Hakkında Kanun (TKHK) ile, tüketici kredilerinde şahsi teminat verilmesi halinde teminatın adi kefalet sözleşmesi olacağı ifade edilmiştir. TKHK, böylece kefili bütün tüketici işlemleri için korumaktadır. Buna göre çalışmada, kefalet sözleşmesinin tanımı, özellikleri, çeşitleri, hükümleri incelenmiş; TKHK bağlamında tüketici kredisi sözleşmelerinde bankalara verilen şahsi teminatlara ilişkin değerlendirmeler 4077 sayılı TKHK ile mukayeseli olarak incelenmiştir.
