Rekabet Hukuku'nun lojistik sektörüne yansımaları

Abstract

Lojistik sektörü her geçen daha da fazla gelişim gösteren bir sektör haline gelmiş olup, artan rekabet içerisinde işletmelerin hassasiyetle üzerinde durdukları bir konu haline gelmiştir. İşletmeler açısından büyük önem arz eden bu konu, onların piyasadaki yerini belirlemede de öncü faktörlerden birisi halindedir. Rekabet çerçevesi içerisinde bu denli önem arz eden bu faaliyet etik değerlerin yanı sıra rekabet hukukuna da uygun gerçekleştirilmesi gerekmektedir. çalışmanın ilk bölümünde lojistik kavramı üzerinde durarak lojistik sektörüne dair detaylı bilgiye yer verilmiş, Türkiye'deki lojistik sektörü, bu sektördeki mevzuatlara ve uygulamalara değinilmiştir. Çalışmanın ikinci bölümünde ise rekabet hukuku kavramı ele alınarak rekabet hukukunun kapsamı, gereklilikleri, uygulanabilir alanları, Avrupa Birliği'ne üye ülkelerdeki, Amerika'daki ve ülkemizdeki rekabet hukuku düzenlemelerine yer verilmiştir. Çalışmanın üçüncü ve son bölümünde ise lojistik sektöründe karşılaşılan rekabet sorunlarına değinilmiş olup, ampirik çalışma gerçekleştirilerek analiz sonuçlarına yer verilmiş ve çalışma tamamlanmıştır. Logistics sector has become a sector showing a continuous growth performance and attracted great attention of companies operating in an environment subject to fierce competition. This sector that is of critical importance for the enterprises serves as a factor determining their position in the market. Logistics activities having such level of importance in terms of competition must be carried out in compliance with the codes of conduct as well as the competition law. Detailed information is given on the logistics sector, a description is provided for the logistics and Turkish logistics sector, legislations and practices in this sector are addressed in the first part of the present study focusing on this subject. The second part of the present study focuses on competition law providing particular information on scope of the competition law, the relevant requirements, fields of application and regulations of the United States, Europe Union member states and our country on competition. The third and final part of the study describes the competition law problems encountered in the logistics sector and the study is concluded upon giving results of the empirical analysis carried out.
