Boşanmada Arabuluculuk

Abstract

Tezde boşanma davalarında maddi hukuk ve usul hukukundaki hükümlere değinilerek dünya uygulamaları ile boşanma uyuşmazlıklarında arabuluculuğun kullanım örnekleri incelenmiştir. Çalışmamda disiplinler arası bir yol izlenmek sureti ile boşanma süreci, sürecin tarafları, çocukları ve boşanmada yargı sonunda verilen kararların büyük oranda uyuşmazlığı çözememesinden kaynaklı psikolojik ve toplumsal etkiler de incelenmiştir. Türkiye'de var olan boşanma uyuşmazlıklarında arabuluculuk sürecinin yürütülmesinin faydalarına değinilmiş sonrasında da Türkiye Cumhuriyeti'nde boşanma uyuşmazlığının nasıl yürütülebileceği konusunda önerilere yer verilmiştir.

In the thesis, world practices and examples of the use of mediation in divorce disputes are examined by touching on the provisions of substantive law and procedural law in divorce cases. In my study, by following an interdisciplinary path, the divorce process, the parties to the process, their children, and the psychological and social effects resulting from the fact that the decisions made at the end of the divorce largely fail to resolve the dispute are also examined. The benefits of conducting the mediation process in divorce disputes in Turkey are mentioned, and then suggestions are given on how divorce disputes can be conducted in the Republic of Turke
