Fikir ve Sanat Eserleri Kanunu kapsamında eser sahipliği

Abstract

Fikir ve sanat ürünlerinin, FSEK'in konusunu oluşturacak nitelikte eser olarak kabul edilmesi ve bu konunun getirdiği korumalardan faydalanabilmesi için birtakım şartların varlığı gerekir. Söz konusu şartların yerine getirilmemesi ya da eksik olması durumunda bu ürünlerin FSEK'te yer alan hukuki ve fiili korumalardan yararlanamayacağı kabul edilmektedir. Çalışmamızda ilk olarak eserin tanımı yapılıp devamında, tanımı yapılan bu eserin sahibinin kim olacağı hususu yargı kararları, Kanun ve doktrin de bulunan fikirler ile birlikte değerlendirilmiştir.

The existence of a set of conditions is necessary for the adoption of the intellectual and artistic products as a work that constitutes the subject of the Law on Intellectual and Artistic Works and to be able to benefit from the protections provided by this subject. If these conditions are not fulfilled or incomplete, it is accepted that these products will not benefit from the legal and actual protections contained in the Law on Intellectual and Artistic Works. In our study, the definition of the work was first made and then the subject of this work is defined with the opinions of the judicial decisions, the law and the doctrine.
